Many people charged with crimes think they should just pick a cheap attorney and get the court dealings over with as fast as possible. This is never a great idea as you could be hiring an incompetent lawyer who doesn’t have the experience to know how to properly handle your case. You would think that any law firm would advise you of the risks during your case and discuss best options, but we have recently scored a win for a client who had apparently never even been told about a plea bargain that was on the table.
At Rector Stuzynski LLC, we have decades of experience as criminal defense attorneys and always thoroughly discuss every aspect of a case with our clients to ensure you understand your case, possible outcomes and the risks that come with pursuing each option. This way our clients can make the best decision as to how to approach the courts and have the best possible chance of a favorable outcome.
In November of 2020, our criminal defense attorney Michael Stuzynkski was able to get our client’s conviction overturned due to the ineffective assistance of the client’s previous attorney. Even better, Mr. Stuzynski was able to get the client out of jail and back with his family. This was a huge win for the client and couldn’t have been accomplished without a knowledgeable lawyer that could prove the ineffectiveness of the previous lawyer’s work.
This specific case was a post-conviction case, meaning the defendant had already been convicted of the crime, was sentenced to prison and was serving time. After contacting Rector Stuzynski LLC, we dug in to investigate all of the things the previous lawyer had done wrong. After a lengthy hearing, the court ruled that the client’s previous attorney had failed to advise him of an offer made by the prosecutor to plead guilty in exchange for a lenient sentence so the client had no idea this was even an option in his case. The court also ruled that the previous lawyer decided to take the case to trial without explaining the risks involved, effectively leading the defendant into a dangerous situation that should have been avoided in the first place.
Michael Stuzynski was able to prove to the courts that our client had not been properly advised and they decided to overturn the conviction due to constitutionally ineffective representation. With that, the client was freed from prison, able to return to his family.
This case has been a perfect example of the repercussions of hiring a subpar attorney to work on your case. For this man, it meant the difference between a lengthy prison sentence and a more lenient deal. Don’t let your future be in the hands of an attorney that just wants to charge you more money. Hire our Top 40 Under 40 award winning lawyer Michael Stuzynski who will always have your best interests at heart so that you can come out of the situation in the best possible way. At Rector Stuzynski LLC, we strive to give every client the attention that they deserve and fight as hard as we possibly can to get great results no matter how big or small the case may be.
