In November of 2020, our criminal defense attorney Michael Stuzynkski was able to get our client’s conviction overturned due to the ineffective assistance of the client’s previous attorney. Even better, Mr. Stuzynski was able to get the client out of jail and back with his family. This specific case was a post-conviction case, meaning the defendant had already been convicted of the crime, was sentenced to prison and was serving time. After a lengthy hearing, the court ruled that the client’s previous attorney had failed to advise him of an offer made by the prosecutor to plead guilty in exchange for a lenient sentence so the client had no idea this was even an option in his case. The court also ruled that the previous lawyer decided to take the case to trial without explaining the risks involved, effectively leading the defendant into a dangerous situation that should have been avoided in the first place.
Michael Stuzynski was able to prove to the courts that our client had not been properly advised and they decided to overturn the conviction due to constitutionally ineffective representation. With that, the client was freed from prison, able to return to his family.
