C.R.S. 10-4-609(1)(c):

The coverage described in paragraph (1) of this subsection (1) (UM-UIM) shall be in addition to any legal liability coverage and shall cover the difference, if any, between the amount of the limits of any legal liability coverage and the amount of the damages sustained, excluding exemplary damages, up to the maximum amount of the coverage obtained pursuant to this section.

Car Insurance Policy

A single policy or endorsement for uninsured or UIM coverage issued for a single premium covering multiple vehicles may be limited to applying once per accident.  The amount of the coverage available pursuant to this section shall not be reduced by a set off from any other coverage, including, but not limited to, legal liability insurance, medical payments coverage, health insurance, or other uninsured or underinsured motor vehicle insurance.

(4) Uninsured motorist coverage shall include coverage for damages for bodily injury or death that an insured is legally entitled to collect from the owner or driver of an underinsured motor vehicle.  An underinsured motor vehicle is a land motor vehicle, the ownership, maintenance, or use of which is insured or bonded for bodily injury or death at the time of the accident.

For Motorcycle Riders

Uninsured motorist insurance coverage provides the motorcyclist financial payment for medical treatment, pain and suffering and loss of enjoyment of life as a result of an accident caused by and uninsured driver. Under-insured motorcycle insurance covers the lack of sufficient insurance coverage between what the driver responsible for an accident could pay and the amount required for your needs as a direct cause of the accident unless your insurance company is acting in bad faith, which is the time to contact a Colorado Springs bad faith insurance lawyer right away to get it resolved.

This is especially critical for a motorcyclist who is always exposed to severe injuries in any collision with another vehicle.

Without question, anyone driving a motorcycle should, at least, obtain a high limit of uninsured motorist coverage. One can imagine an injury where $500,000 may not be enough.  Don’t gamble on the other driver, who caused the accident, to have sufficient liability coverage to provide you full compensation for your injuries and damages.  Uninsured/Underinsured Motorists coverage is a personal coverage for you and your passengers.

There may be other insurance coverage available to cover your injuries which you might not know. We would advise that you contact a qualified motorcycle accident attorney after an unfortunate motorcycle accident. Be careful to avoid “quick settlements”. You may be significantly discounting your claim and foreclosing your ability to obtain more compensation.
